On August 12, 2020, the amendment and addition of four articles to Executive Decree No. 42248-MTSS “Regulation for the procedure of temporary suspension of employment agreements in cases related to sections a) and b) of Article 74 of the Labor Code”, were published in the Official Gazette.

These amendments were added to de Executive Decree to provide employers with the possibility of temporarily suspending the application of the suspension of employment agreements measure. This measure will allow employers to have more flexibility regarding the management of their staff and, hence, they will be able to respond, in a timely manner, to changes in their day-to-day business, without having to wait for a response from the Ministry of Labor.

However, the employer must inform its employees 48 hours before applying the temporary suspension of the measure.

To proceed accordingly, the Ministry of Labor enabled an online form on their website so that employers or their legal representatives can notify the Ministry of the temporary lifting of the suspension of the employment agreements.
