From April 16, 2020, the day after the publication in the Official Gazette of Law 147 of April 15, 2020, a special license is created for the care of a child or adolescent with leukemia, cancer or degenerative disease for employees in the public or private sector who have in their custody or care a minor under 18 years of age suffering from a disease that has a serious or terminal condition.

According to the law, advanced, progressive, and incurable disease is considered serious or terminal if:

1. It is the result of a diagnosis of leukemia, cancer, advanced chronic disease of an organ, degenerative disease of the central nervous system, evolved coma of various causes, or any other disease in an evolutionary and irreversible phase.
2. The patient has stayed at least overnight in a hospital, hospice, residential health care facility, or another medical facility.
3. The patient is at risk of death, whose treatment, in the judgment of the treating physician, requires the presence of the parents who exercise parental authority, tutor, a curator, or the closest family member of the patient for their care.

In this sense, the employee can make use of a leave of absence for a period of up to 3 months, which cannot be extended, with the right to receive 100% salary payment from the employer, provided that he/she meets the following requirements:

1. Notify the employer (15 days in advance if it is a scheduled surgery or 3 business days if it is an emergency or untimely illness), the name, surname, and degree of relationship of the person in charge, together with a certificate of birth issued by the Civil Registry.
2. Provide the employer with a report issued by the patient's doctor indicating the patient's full name, type of illness, condition, and justification for the need for accompaniment.

During the leave period, the employee may not work for any other employer or as self-employed. Once the term of the leave has expired, the employee must return to their job or, in case of not doing so, it will be considered as an abandonment of the job.

This special license may be canceled if the patient dies or at the request of the employee or family member in charge.
